SPHERION WINTER GAMES OFFICIAL RULES

NON-COMPLIANCE WITH ANY OF THE FOLLOWING OFFICIAL CONTEST RULES WILL RESULT IN DISQUALIFICATION.

The odds of winning depend on the total number of eligible entrants. 

Eligibility: 

To be eligible to enter and/or win the SPHERION 2022 WINTER GAMES (“Contest”), you must be 18 years of age or older at the time of entry; a legal resident of the United States; an employee of Spherion or a participating Spherion franchisee and in “good standing.”

Good standing is defined as: Currently an active temporary employee of Spherion or a participating Spherion franchisee (temp or temp-to-perm) on date of entry and date of award of any prize; Has complied with all explicit obligations, while not being subject to any form of sanction, suspension or disciplinary censure; Has not tendered oral or written notice of intent to resign or retire effective as of a date on or before the conclusion of the Contest Period or the awarding of any prize; Has no pending investigations or lawsuits that would affect one’s employment status (based on local, state and federal government laws). 

Conditions not related to “good standing” include: Being late or missing work that is less than the defined minimum expectations of the job; Perceptions based on an opinion of an individual vs. facts based on employment criteria; Preconceived opinions based on past experiences or history prior to or during the start date of the Contest. 

Employees, representatives, consultants, subcontractors, and agents of Randstad or any of its subsidiaries or affiliates (other than Spherion), or of the Spherion Franchisees, as well as their spouses and dependents, are not eligible to enter this Contest or to win the Contest prize. Nor are the temporary employees of non-participating Spherion franchise offices. 

Winner Selection: 

Entries from prospective winners will be randomly chosen from all eligible employees as follows: A weekly report will be pulled of all active temporary employees employed by Spherion or Spherion franchisees; Reports will be downloaded and consolidated into a Microsoft Excel spreadsheet document each week with chronological numbers for each eligible employee; Winners for each prize will be chosen through a random on-line generator at RANDOM.ORG and will be matched to the corresponding number on the Microsoft Excel spreadsheet; There will be two (2) alternate Contest winner back-ups for each prize in the event the original winner is deemed ineligible or fails to claim the prize.

Each eligible employee will be entered into the drawing for that week’s prizes, receiving one (1) entry for that week.  However, for the Regional Grand Prize drawing, each eligible employee will receive an entry for each week employed by Spherion or its franchisees during the Contest period, up to a maximum of six (6) entries.  By way of example, if an eligible employee has been employed by Spherion for five (5) weeks when the Regional Grand Prize drawing occurs, that employee will receive five (5) entries for the Grand Prize drawing.  Employees who have converted to the payroll of the client to which the employee was assigned will remain eligible after conversion for the Grand Prize drawing only.  Converted employees will not otherwise be eligible to win any prizes after conversion. Each winner will be limited to one (1) prize during the Contest Period.

Prospective winner entries will be confirmed by the corresponding Spherion franchisee employer as follows: The franchise owner will receive an email notification of the prospective winner two (2) weeks prior to the public announcement of the winner; The franchisee or their designated contact will confirm the prospective winner is eligible based on the criteria outlined in these rules. Confirmation of eligibility will be completed via a shared Google Document which will include the electronic signature of the franchisee or their designated contact. If the prospective winner is not confirmed eligible, the first back-up winner will be next in line with notification of eligibility in the same manner. If the first back-up winner is not confirmed eligible, the second back-up winner will be next in line with notification of eligibility in the same manner. If the second back-up winner is not confirmed eligible, Spherion will continue to secure back-up prospective winners until one is confirmed eligible. Chosen eligible winners may not transfer their prize to another person or party for the purposes of this Contest.

Any determination made by Spherion regarding the eligibility and selection of eligible and final winners shall be final and binding.  

Prizes: 

Regional Gold Grand Prizes (3) of $5,000 per region.

Regional Silver Grand Prizes (3) of $2,500 per region.

Regional Bronze Grand Prizes (3) of $1,000 per region.

Weekly Gold Prizes (3) of $500 per region.

Weekly Silver Prizes (3) of $250 per region.

Weekly Bronze Prizes (3) of $100 per region.

Specific final prize details will be determined by Spherion and are subject to change based on discretion of Spherion. 

The Contest will start on or around January 31, 2022 at 12:00 am Eastern Standard Time and will end with the Grand Prize winners being announced on or around March 9, 2022 at 12:00 pm Eastern Standard Time.  All dates and times are subject to change or cancellation.

Contest winners will be notified by a telephone call, text, and/or email from the Spherion franchisee employer specifying that the winner must contact a specific official at their local Spherion franchisee branch location.

Notification is to determine if the winner is able and willing to accept the Contest rules and the prize under the terms and conditions set forth herein.  Each winner is required to respond to a specific official at their local Spherion franchisee branch location in person, by a telephone call, text, and/or email within two (2) calendar days of the first attempted notification from Spherion.  If the prospective winner fails to contact that Spherion official and respond as required or is otherwise unavailable to receive the notification for whatever reason, such that no response is received by 5:00 p.m. Eastern Time on the second (2nd) calendar day following the first attempted contact by email, telephone call or text to the prospective winner, then any right or interest of the prospective winner in the Contest prize or this Contest shall be promptly forfeited.  No other notification will be required to be made by Spherion to the prospective winner that fails to respond for any reason, the selected prospective winner shall forfeit their rights and interest.  If the prospective winner has forfeited their interest in the prize and this Contest, an alternate winner selected through a random drawing will then be declared the “winner” of that specific prize by Spherion, as described above.  Once an alternate winner is selected as the prospective winner, then that alternate winner must accept the Contest rules and the prize under the terms and conditions set forth herein and must comply with all Contest rules as applied to the winners.

Non-compliance with any of the Contest rules may result in disqualification.  

Spherion’s decisions are final on all matters relating to this Contest.  After winners have been selected for the weekly regional prizes and regional grand prizes, each winner agrees to timely execute Spherion’s Prize Acceptance and Liability form, an Affidavit of Eligibility form, W-9 form (for IRS purposes), and any other documents Spherion, in its sole discretion, requires, and then promptly deliver the executed forms to the Spherion before the winner takes possession of these weekly and regional grand prizes.

RELEASE OF LIABILITY: 

Upon acceptance of the prize, the winner, his or her heirs, executors, representatives, successors, and assigns, forever releases from any and all liability, loss, harm, damage, cost or expense whatsoever, regardless of how it was incurred, and including without limitation, any and all claims for property damage, personal injury, and/or death which may occur in connection with the winner’s acceptance, ownership, possession and/or use of the prize, each of the following: Spherion Staffing, LLC and its parents, subsidiaries, affiliates, owners, officers, directors, shareholders, employees, representatives, suppliers, agents,  associates and advertisers; and any parties, individual or entities involved with this Contest, its promotion, and public relations and production agency associated with this Contest (“Released Entities”)

Winners consent to the use of his/her name, voice, performance, entry, and/or likeness for programming, advertising, publicity and promotional purposes in any and all media, now or hereafter known, worldwide and on the Internet, and in perpetuity by Spherion and its designees, without compensation (unless prohibited by law) or additional consents from entrant or any third party and without prior notice, approval or inspection, and to execute specific consent to such use. 

Winners agree that he/she will not conduct or participate in any media interview regarding this Contest or any prize without the express prior written permission of Spherion.  Spherion is not responsible for any unauthorized human intervention or other causes that corrupt or improperly affect the administration, security, fairness or proper play or conduct of this Contest.  Spherion will not be responsible to award any value in excess of the value listed in these rules.

Contest is void where prohibited, taxed or restricted by law.  If there exists any laws, bonds, taxes, and/or restrictions that actually apply to any valid contestant, participant, winner; then the Contest is void for such individuals (“Void Individuals”).  Whether or not such information is known or unknown to all the parties before or after this contest. Any such Void Individuals are unable to participate and/or claim the award to become a winner.  If the winner is determined to be a Void Individual after the prize has been awarded, Spherion reserves the right to require that the winner return the prize awarded.  Spherion conducts numerous giveaways and will not be held responsible for resolving potential or actual claims of Void Individuals.

MISCELLANEOUS: 

Spherion is not affiliated with any Olympic games, the International Olympic Committee, International Federations of any winter sports, or any individual Olympic athletes or teams;  nor are these entities sponsoring or endorsing Spherion or the Spherion 2022 Winter Games. 

Released Parties are not responsible for any typographical, printing or other error in connection with this Contest, including, without limitation, errors in the printing of these Official Rules or any advertising or promotional materials, the administration of the Contest, the processing of entries, the announcement of the prize or in any other Contest-related materials.  Released Parties are not responsible for lost, late, incomplete, illegible, damaged, inaccurate, stolen, delayed, misdirected, undelivered, inaccurate entries or lost or stolen entries. Entries made in violation of these Official Rules, as solely determined by Spherion, will be void and the corresponding entrant may be disqualified.  Should any portion of the contest be, in Spherion’s sole opinion, compromised for any reason, or should any cause, in the sole opinion of the Spherion, corrupt or impair the administration, security, fairness or proper play, or submission of entries, Spherion. reserves the right at its sole discretion to terminate the contest (or portion thereof) and, if terminated, at its discretion, select the potential winners from all eligible, non-suspect entries received in a random drawing from among all eligible entries received.  CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS.

Winner Identification: 

The identification of all Winners will be made available by sending a written request (in English only) for that information, together with a separate, stamped (first class mail), and self-addressed envelope (#10) to: WINNERS of the 2022 SPHERION WINTER GAMES, 3625 Cumberland Blvd SE, Atlanta, GA 30339 to be received after December 3,, 2021 and before January 10, 2022.

Social Media Disclaimer and Acknowledgment: 

This contest is in no way sponsored, endorsed or administered by, or associated with Instagram, Facebook, Twitter, LinkedIn, or TikTok  (the “Social Media Platforms”).  Each contestant and winner agrees to a full and complete release of each of the Social Media Platforms in connection with this Contest.
